Expected publication date

We have spoken to the Ministry of Justice who told us that the final guidance related to the defence of Adequate Procedures is not expected to be published before the end of January 2011.

Don’t put it off

We advise that Companies do not wait for the publication of the guidance before getting to grips with putting Adequate Procedures in place before the April deadline for the new law.

We have written about Adequate Procedures on many occasions (all our relevant posts are here). There is no mystery to what Companies need to do to comply and no need to delay preparing for the new law pending publication of the guidance which we do not anticipate being materially different to the draft guidance published earlier this year.
